Important: MedBill provides medical bill auditing as an informational service. We are not a healthcare provider, insurance company, or law firm. Our AI-powered analysis identifies potential billing discrepancies — it does not constitute medical or legal advice. By using MedBill, you agree to these Terms.

1. Acceptance of Terms

By accessing or using MedBill (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms; continued use after changes constitutes acceptance.

2. Description of Service

MedBill is an automated medical bill auditing platform that:

  • Free Scan: Analyzes uploaded medical bills and provides an estimated savings range based on error probability. No specific findings are revealed without payment.
  • Full Audit ($29 one-time): Provides a detailed line-by-line audit report, including detected errors (upcoding, unbundling, duplicate billing, modifier errors, balance billing, denial code analysis), CMS rate comparisons, a ready-to-send dispute letter, and a phone negotiation script.
  • B2B Plans ($99-$299+/month): Bulk audit processing for medical practices, clinics, and billing departments with dashboard, API access, and priority support.

2.1 Service Limitations

  • Our analysis is based on CMS Physician Fee Schedule rates, CPT coding rules, and LLM pattern detection — not a definitive legal or medical determination.
  • We do not guarantee that errors exist on any given bill, nor that identified errors will result in successful dispute resolution.
  • Dispute letters and phone scripts are templates generated by AI. They should be reviewed and customized before use.
  • Processing times are estimates. Actual times may vary based on file quality, system load, and complexity.

3. Eligibility

You must be at least 18 years old to use the Service. By using MedBill, you represent that: (a) you are 18 or older, (b) you have the authority to upload the medical bill you submit, and (c) your use complies with all applicable laws.

4. Account Registration

Certain features (B2B plans, payment history) may require account creation. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@medbill.ai of any unauthorized use.

5.2 Refund Policy

  • Full Audit: Full refund if the audit report is not delivered within 7 days of payment. Partial refunds (50%) available within 30 days if you believe the analysis was materially inaccurate — subject to our review.
  • B2B Plans: 14-day free trial. Cancel anytime before trial ends with no charge. After trial, refunds prorated for unused portion of the month within the first 30 days of a paid subscription.
  • Dispute of Charges: If you believe you were charged in error, contact support@medbill.ai within 60 days. We will investigate and resolve within 14 business days.

5.3 Payment Processing

All payments are processed securely through Stripe, Inc. MedBill does not store full credit card numbers, CVV codes, or bank account details. Stripe's terms and privacy policy govern payment data processing. By purchasing, you agree to Stripe's Terms of Service.

6. User Responsibilities

You agree to:

  • Submit only medical bills and EOBs that belong to you or for which you have legal authorization
  • Not upload files containing malware, viruses, or malicious code
  • Not use the Service for any fraudulent or illegal purpose
  • Not attempt to reverse-engineer, copy, or resell the audit engine or its outputs
  • Not submit more than 10 bills per day on the Free Scan tier (rate limiting enforced)
  • Provide accurate contact information for report delivery

7. Disclaimers

No Medical or Legal Advice

MedBill is NOT a healthcare provider, medical professional, or law firm. Our Service:

  • Does not practice medicine or provide medical diagnoses
  • Does not practice law or provide legal opinions
  • Does not guarantee billing error correction or refunds
  • Does not represent you in disputes with healthcare providers or insurers
  • Generates suggestion letters — you are responsible for their use

7.1 No Guarantee of Savings

Savings estimates provided by MedBill are illustrative projections based on CMS rate comparisons and billing pattern analysis. Actual savings depend on successful dispute resolution with healthcare providers and insurers. We do not guarantee that you will save any specific amount or that any errors identified will be corrected.

7.2 AI Accuracy

Our analysis uses artificial intelligence (large language models) combined with CMS rate databases. While we strive for high accuracy, AI systems can produce false positives or miss certain errors. We recommend reviewing all findings before taking action. We are not liable for errors in the analysis.

7.3 Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted availability. We are not liable for damages from service interruptions, processing delays, or data loss beyond our reasonable control.

8. Limitation of Liability

To the maximum extent permitted by law, MedBill and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to:

  • Loss of savings or financial gain
  • Failed billing disputes with healthcare providers
  • Legal or medical expenses incurred as a result of using our reports
  • Data loss or unauthorized access beyond our reasonable security measures

Our total liability for any claim shall not exceed the amount you paid us for the specific service giving rise to the claim. For free scan users, liability is limited to $0.

9. No Surprises Act Compliance

MedBill's dispute letter service operates in compliance with the No Surprises Act (Public Law 116-260), effective January 1, 2022. Specifically:

  • Our dispute letters reference applicable patient protections under the No Surprises Act
  • We identify potential balance billing violations where out-of-network providers bill above in-network rates
  • We do not guarantee No Surprises Act protections apply to your specific situation
  • Consult a qualified attorney for advice on federal or state surprise billing protections
  • For complaints about surprise billing, contact the CMS No Surprises Help Desk

10. Intellectual Property

MedBill, the MedBill logo, the audit engine, report templates, and all related software are the intellectual property of MedBill Inc. The audit report generated for you (including findings, dispute letter, and phone script) is licensed to you for personal, non-commercial use in pursuing billing disputes. You may not resell, redistribute, or sublicense the report or its contents.

11. Termination

We may suspend or terminate your access to the Service if you violate these Terms, engage in fraudulent activity, or if your use poses a security risk. Upon termination, your access to reports and data will be revoked. You may terminate at any time by discontinuing use. Sections 6-13 survive termination.

12. Indemnification

You agree to indemnify and hold harmless MedBill Inc., its officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service in violation of these Terms, (b) your submission of bills you are not authorized to submit, or (c) your use of audit reports in a manner that violates applicable law.

13. Dispute Resolution & Arbitration

Informal Resolution First: Before filing any claim, you agree to contact us at support@medbill.ai to attempt informal resolution within 30 days.

Binding Arbitration: Any dispute arising from these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be held in Wilmington, Delaware, or virtually at your option.

Class Action Waiver: You agree to resolve disputes on an individual basis. No arbitration or proceeding may be consolidated with another or conducted on a class-action or representative basis.

Exception: Either party may seek injunctive relief from a court of competent jurisdiction to protect intellectual property rights or prevent disclosure of confidential information.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms constitute the entire agreement between you and MedBill regarding the Service and supersede any prior agreements or understandings, whether written or oral.
